I should mention that I still get a error but at least it is finally stopped.

"A timeout occured while waiting for the vserver to finish and it was killed by sending a SIGKILL signal. Please investigate the reasons and/or increase the timeout in apps/vshelper/sync-timeout."

Issue: Unable to stop vserver, everything else appears to work fine.

Issue was resolved when dietlibc was installed and tools recompiled

EG:
Installed dietlibc
cd /path/to/vserver/src/util-vserver-0.30.208
make uninstall
make clean
./configure
make
make install

Note: allowed ./configure to autodetect dietlibc

from config.log
...
configure:9473: checking whether to enable dietlibc
configure:9533: result: yes (autodetected, 0.29)
...

should be fixed in CVS and 0.30.208+; there, 'vwait' will be used with a configurable timeout. When the timeout will be reached a SIGKILL will be sent to the vserver.

maybe some 'timeout' would be appropriate here
(afther which the context is killed)
