I've made a couple of tiny changes, but this is the exception that you should add to all of the relevant source code files, below the normal Copyright and GPL header stuff.

You should replace DEF and XYZ in your exception notice with their real names. Please note that OpenSSL is released under two licenses, so you should mention both of these.

Hi,

The OpenSSL's "exemption" is very unclear. The condition you are dealing with does not require an exemption at all, but an exception.

Please use the exception notice from http://www.gnu.org/licenses/gpl-faq.html#GPLIncompatibleLibs It deals with yor placing of an exception much more clearly, and would ensure your code is correctly licensed. The OpenSSL exemption that you have used does not deal with modified versions or any other such conditions.

If you have any questions about this, please ask.

I have make the change you require. I take the GPL exception from http://www.openssl.org/support/faq.html#LEGAL2.
The source tree attached is full (the file i removed the last time was only some old docs that we don't want to release).

I have discussed with other people of the team and we have decided to continue to use openssl (ve insert the exception in GPL) and agree to change Linux to GNU/Linux.
Now we are waiting for our response because we really need a cvs for coordinate the team change at source.

For the problem of calling "Linux" as "GNU/Linux" i think there is no problem ad also to switch from ssl to gnutls.
Now i attach the source code with ssl support. I have also send a mail at the other people involved in the project to known is they agree to remove ssl.

I'm evaluating the project you submitted for approval in Savannah.

"Linux" is just a kernel of a more complex system that we like to refer to as GNU/Linux, to emphasize the ideals of the Free Software movement.

Would you mind changing references to Linux as an OS to GNU/Linux?

Secondly, using OpenSSL in your project is problematic, as its license is incompatible with the GNU GPL, which your software is released under.

From http://www.gnu.org/philosophy/license-list.html :

"The license of OpenSSL is a conjunction of two licenses, One of them being the license of SSLeay. You must follow both. The combination results in a copyleft free software license that is incompatible with the GNU GPL. It also has an advertising clause like the original BSD license and the Apache license."

We recommend using GNUTLS instead of OpenSSL in software you write. If you still must use OpenSSL, you should add an exception, like that of GNU wget. More information can be found at http://www.openssl.org/support/faq.html#LEGAL2 and in the GNU wget source code.

We would prefer you to use GNUTLS though. Please provide us with information on what you intend to do.

Finally, please include a (perhaps temporary) URL pointing to the source code. Alternatively, you can forward the code to me by email.

We wish to review your source code, even if it is not functional, to catch potential legal issues early.

For example, to release your program properly under the GNU GPL you must include a copyright notice and permission-to-copy statements at the beginning of every  copyrightable file, usually any file more than 10 lines long.  This is explained in http://www.gnu.org/licenses/gpl-howto.html.  Our review would help catch potential omissions such as these.

Note that sending code to our repositories is a release, since the code will then be publicly available through anonymous access.
