Using BSD for your framework works.
If you want more copyleft for your code, using the LGPL works too.

I approved the project with the mBSD license for now. Just let me know whenever you want to modify the project license.

Yes this point is clear but it was already clear. Probably I did'nt explain myself well.

I think there is another point of view, but I'm not sure it's correct.

Let me resume a table of licenses:

Smak includes 16 classes at th moment:
LGPL    3
BSD    7
PHP    4  (all pear packages)
Mit    2

As a first step I would like to realize smak under BSD. I'm waiting since several months and I would like to finally publish it.
I'm already working with pear developers to change their packages from php to bsd. When this target will be reached I'll switch smak license to GPL. (second step)

Do you think that this should work ?

I mean that you can't publish a framework that combines PHP dependencies and GPL-without-exception dependencies.

Is that clearer?

I mean that I have 16 classes included in smak atm (also considering classes not still used). Atm only 4 are php licensed and they will be only 3 when the pear guys will release the code under bsd license as written in this announcement made by Helgi (pear member) at pear's dev ml. http://news.php.net/php.pear.dev/50797

What do you mean? Of course there are LGPL classes included in smak (and probably there will be GPL classes too, sooner or later) but I don't think this is a problem right? BSD can't be considered a closed license so I think it could be perfect also in that situation, right?

If everything is ok for you I would like to change smak license to bsd and to go on as planned (i.e. moving it at gpl v3 asap)
Can you change the licence for this project and approve it?

I could publish smak under the X11 (MIT) licence or Modified BSD, until all  (are only 6 atm) the not-gpl classes are modified into a gpl compatible license. When it will happen I modify to gpl v3 or later.
This should be a fast and quite good compromise, also considering that Smak is still in heavy development.

I spoke with some pear members and it seems possible that some packages will be licenced under New BSD rather then PHP 2 or 3.
Now I also know that all the BSD licenses from pear are already New BSD licenses. That's good. Anyway I think it will take time.

So, if my option is valid, how could I switch the license type here on savannah?

I know, but if it would be New Bsd? It could be used also in other GPL project without any project. Right?

lol no for sure and smak is absolutely not comparable with them. it's just a small project. :-)

The closest license GPL-compatible license is the modified BSD license. People who used the PHP license for a PEAR library should have no problem switching to mBSD, unless they didn't keep track of contributors (that's what happened with QuickForm v1).

Thank you very much Beuc for your help. It was really welcome.
I studied what you underlined in your reply.
I'm in a hard situation because I use both gpl and non-gpl php classes: so if had an exception for the non-gpl I lock out the possibility to use the gpl classes.
Personally I really would like to use a gpl licence but being in this way I think it's better to choose another licence because it makes no sense to rewrite all that good code (but unfortunatly not gpl code).
I'll try to contact the authors of every class to understand if there is the possibility to obtain a gpl licence for it. If not I think that I'll need to modify the licence, maybe bsd or php if there are not problems also with them.
Do you see any other solution? (rewrite all the code it's not an option atm)

Yes.

Since the PHP license is incompatible with the GPL, the only way you can combine the problematic PEAR dependencies and your own code is to add an exception like http://www.gnu.org/licenses/gpl-faq.html#GPLIncompatibleLibs for each incompatible dependency. You also need to be the copyright owner of all the GPL'd code, and you can't incorporate GPL'd code from other people if they didn't give the same exceptions.

So, for a framework it makes like sense to use such exceptions, as it will require all your GPL users to apply the same exceptions, which they may not be able to do, for example if they use another GPL'd library.

If you need help with licensing the reference resource is the GNU Compliance Lab at licensing@gnu.org.


Aside from that your source code only specifies version 3 of the GPL, while we recommend to use "version 3 or later". You may want to use more common file headers as explained in the GPL howto http://www.gnu.org/licenses/gpl.html#howto


I'm not sure what you want to do now with this registration. Do you want to get more information from the GNU compliance lab first?
